These Terms of Service govern your use of the QuickSitters platform and services. By creating an account or submitting a booking, you agree to these terms in full.

1. Nature of Services — Referral Agency

QuickSitters LLC operates as a domestic referral agency under California Labor Code Section 2777 and California Civil Code Section 1812.5095. We facilitate connections between families (“Clients”) and independent childcare providers (“Sitters”).

QuickSitters LLC is not the employer of any Sitter referred through our platform. Sitters are independent service providers. By engaging a Sitter through QuickSitters, the Client assumes responsibility as the directing party for the work performed in their home.

Sitter Selection:

All Sitters referred by QuickSitters maintain full independence, including the right to:
 
•Accept or decline any referral without penalty
•Set their own availability and preferred working hours
•Work with other families or agencies outside of QuickSitters
•Negotiate terms directly with Clients when applicable
 

Branded Materials:

QuickSitters may optionally provide Sitters with branded shirts and suggested activity materials for children as a courtesy. Sitters are not required to use these materials and their use does not constitute employment or control by QuickSitters.

2. Client Responsibilities

As a Client, you agree to:
 
•Provide accurate information about your children including ages, allergies, medical conditions, behavioral needs, and any relevant instructions
•Ensure your home environment is safe and appropriate for childcare
•Disclose the presence of pets, security systems, and household rules to the Sitter prior to the booking
•Be reachable by phone during the entire duration of the booking
•Treat Sitters with respect and professionalism
Failure to disclose material information that affects the safety or performance of the booking may result in cancellation without refund and suspension of your account.
 

3. Cancellation Policy

We work hard to reserve Sitters for your family. Cancellation fees ensure Sitters are compensated for their reserved time. The following rules apply in order of priority  the most specific rule applies first:

Timing 

  • Within 1 hour of confirmation (Sitter not yet en route)  No Fee 
  • After 1 hour of confirmation and no more than 2 hours before start time 25% of total cost
  • Less than 24 hours before start time 50% of total cost 
  • After Sitter is en route or has arrived 100% of total cost 
  • Booking canceled 7+ days in advance 25% of total cost 
  • No show (Sitters waits 30 minutes Without contact ) 100% of total cost 

Refunds are processed within 5–7 business days to your original payment method.

4. Supervision, Safety & Liability

Safe Environment:

Clients are responsible for providing a safe home environment and disclosing all relevant information before the booking begins.

Emergency Response:

In the event of an emergency, Sitters are authorized to contact emergency services and act in the best interest of the child. Sitters shall not be held legally liable for actions taken in good faith during an emergency situation.

Limitation of Liability:

QuickSitters LLC is a referral agency and is not responsible for:
•Incidents caused by inaccurate or withheld information from the Client
•Unsafe home conditions not disclosed prior to the booking
•The independent actions or decisions of any Sitter once on-site
•Any situation beyond QuickSitters’ reasonable control
To the extent permitted by California law, QuickSitters LLC’s total liability to any Client shall not exceed the referral fee paid for the specific booking in question.

5. Payment Terms

All payments are processed through the QuickSitters platform. Accepted payment methods include Stripe, PayPal, and Zelle.
Pricing is based on the package selected at the time of booking. Additional fees apply for extra children as disclosed on the pricing page.
Payments collected by QuickSitters on behalf of a Sitter will be held in a designated account and disbursed to the Sitter following completion of the booking, in accordance with California Civil Code Section 1812.5095.

6. Photo & Video Permissions

QuickSitters respects your privacy. No media involving your children will be captured, stored, or shared without your explicit written consent provided in the booking form.
We will never:
•Use children’s images for AI training or facial recognition
•Share identifiable information such as home addresses or school names
•Distribute any media to third parties without your consent
You may revoke media consent at any time by emailing hello@quicksitters.com. Revocation applies to future use only and does not affect media already published with prior consent.

7. Privacy & Data Protection (CCPA)

In accordance with the California Consumer Privacy Act (CCPA), QuickSitters LLC is committed to protecting your personal information.
What we collect: Name, contact information, children’s details, and booking history — solely to provide our services.
What we never do: Sell, rent, or share your personal data with third parties for commercial purposes.

Your rights under CCPA include:

 
•The right to know what data we hold about you
•The right to request deletion of your data
•The right to opt out of any data sharing
To exercise any of these rights, contact us at hello@quicksitters.com. We will respond within 45 days as required by law.

8. Protection of Minors (COPPA)

QuickSitters does not knowingly collect personal information from children under the age of 13. All accounts must be created by adults 18 years of age or older. If you believe a minor has created an account, please contact us immediately at hello@quicksitters.com.

9. Account Termination

QuickSitters reserves the right to suspend or terminate any Client or Sitter account for violations of these Terms, including but not limited to: providing false information, unsafe conduct, repeated cancellations, or behavior that endangers the safety of children or Sitters.

10. Dispute Resolution

In the event of a dispute between QuickSitters and a Client or Sitter, the parties agree to first attempt resolution through good faith communication. If unresolved, disputes shall be submitted to binding arbitration in San Diego County, California, under the rules of the American Arbitration Association.
Nothing in this section prevents either party from seeking emergency injunctive relief in a California court of competent jurisdiction.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any legal proceedings shall take place in San Diego County, California.

12. Changes to These Terms

QuickSitters LLC reserves the right to update these Terms at any time. We will notify registered users of material changes via email. Continued use of the platform after changes constitutes acceptance of the updated Terms.
